What to do after a motor vehicle accident?First, move your vehicle off of the roadway, if it's possible to do so safely. Call 911 and report the accident; if you are asked if anyone is hurt, say I'm not sure. If you have any doubt whether you or someone in your vehicle has sustained a back injury, wait until medical personnel arrive before attempting to move. Don't apologize for the accident, even if you think your actions may have contributed to it. If you are able, offer your driver's license and proof of insurance to the other driver. Ask to see the other driver's license and proof of insurance. From the driver's license, write down the other driver's name, address, date of birth and Texas driver's license number. From the proof of insurance card, write down the name of the insurance company, the policy number, the insurance company's telephone number if listed, and the names of anyone on the insurance card. Also write down the make, model, and color of the other driver's vehicle. Survey the accident scene to understand exactly how the accident occurred. Note the name of the street on which the accident occurred, the posted speed limit, traffic conditions, and the like. The details of the accident will become important later. In fact, if you have a camera with you, it's also a good idea to take photographs of the accident scene. If anyone saw the accident and stopped afterwards, ask them what they saw, and make sure to write down their name and telephone number. Witnesses like this can be very helpful later in the process, particularly if a disagreement arises, for example, about who had the right of way at an intersection or in entering a lane of traffic. Talk to a personal injury attorney before contacting the insurance company. When I represent a client in a motor vehicle accident, I handle the communication with the insurance company so that they client doesn't have to worry about saying something that may come back to hurt them later in the process.
