How much does an attorney cost?The fee that we charge for handling accident cases is one-third, or 33 1/3%, of the recovery. This is the standard fee that lawyers charge for handling accident cases. In the event that a lawsuit is eventually filed in connection with a claim, the fee goes up to 40% of the recovery, due to the additional legal work required when a lawsuit is filed. In most cases, however, we are able to settle clients' claims without having to file a lawsuit, so in most cases, the fee is one-third of the recovery. There is also another way of looking at the issue of attorney's fees, and it has to do with a study that was done several years ago by the Insurance Institute. In that study, researchers found that accident victims who retain lawyers to help them with their claims recover approximately three and a half times more than people who attempt to settle their claims on their own. The reason for this is fairly clear. When someone attempts to settle their own claim, whether arises from a slip and fall accident at a business, or from a car accident, they're dealing with an adjuster who handles these times of cases every day, all day long. Insurance adjusters typically receive extensive training from the insurance companies in handling injury claims. The multi-billion dollar insurance companies are able to use their resources to aid their adjusters in handling accident claims. For example, the adjuster will likely have access to insurance company lawyers who can advise the adjuster on specific legal issues that may arise in your claim. The adjuster will also likely be able to send your medical records and bills to insurance company doctors and nurses, who give provide the adjuster with "expert" opinions regarding the amount of treatment that you received, and the amounts charged by the doctors who treated you. Armed with this type of information, adjusters then usually attempt to argue that the doctors provided unnecessary treatment to you, or that your doctors charged too much for their services, or both! Having a lawyer on your side helps to level the playing field, so that there is someone on your side who is familiar with the strategies and tactics that the adjusters use in handling car wreck cases, business premises cases, as well as other types of accident cases. Choosing not to have someone help you through the process can often be the most expensive choice that you can make, resulting in a much lower settlement for your claim than you are entitled to.
